The trial is the heart of the process: first of all, preliminary issues will be verified and discussed, so witnesses and consultants will be heard on both the prosecution and the defense, according to the “cross-examination” technique (in italian “controinterrogatorio“).
The victim is ordered to appear at the first hearing and can ask for a compensation for damages, by turning oneself in a civil party. Travel expenses may be refunded by order of the Judge.
After the acquisition of the necessary material for the decision, the discussion follows the order established by art. 523 c.p.p.
The defendant, at his request, has the right to have the last word. After all the evidence has been heard and once the Public Prosecutor and the defence lawyers have argued their cases, the Judge retires to make his decision.
