Straight answers about cross-border family law
Do I need an Italian family lawyer if I live outside Italy?
If your marriage, children, former partner, property or ongoing proceedings have a connection with Italy, you may need Italian legal advice even if you live elsewhere. The first task is to establish whether Italy has jurisdiction and how any Italian process interacts with the other country involved.
Can I divorce in Italy if I was married abroad?
Possibly. The answer depends on factors such as nationality, habitual residence, where the spouses live and whether proceedings have already started elsewhere. We can assess the Italian position before you take formal steps.
How is child custody decided in Italy?
Italian law commonly provides for joint custody, meaning both parents retain parental responsibility. That does not necessarily mean equal time with each parent. The court or agreement will address the child’s living arrangements, time with each parent, major decisions and financial support, with the child’s welfare as the guiding consideration.
Can we agree a separation without going to court?
In some cases, yes. Italian law provides routes including lawyer-assisted negotiation, although different safeguards apply where there are minor children or adult children who are not self-sufficient. The agreement must be structured correctly to have legal effect.
Will I have to travel to Italy?
Not always. Much of the advice, preparation and communication can be managed remotely. Whether personal attendance is required depends on the procedure, the court and the particular facts of the case.
Can an Italian court order child or spousal maintenance?
Yes. Italian law provides for different forms of family financial support, including child maintenance, maintenance during separation and divorce-related allowance where the legal conditions are met.
Can a foreign divorce or custody order be recognised in Italy?
Often, but the process and requirements depend on where the order was made, when proceedings began and the issue involved. Recognition and enforcement should be reviewed before relying on an overseas order in Italy.
